Permission under the Local Government (Planning and Development) Acts is required for structures for making or storing silage with a floor area exceeding 300 square metres. In such cases, it is for the planning authority, or An Bord Pleanála on appeal, to determine what conditions may need to be attached to the permission to regulate separation from dwellings. Smaller silage structures may be constructed without planning permission, subject to compliance with conditions laid down in regulations. One of these conditions is that no such structure may be situated within 100 metres of any dwelling house, save with the consent of the owner and the occupier.
