Question:

184 Mr. Garland asked the Minister for Justice if his attention has been drawn to the fact that the legislation currently in force concerning public rights of way is not as effective as, for example, in Britain; and if he has any plans to amend the current legislation.

The law on public rights of way is not contained in legislation but forms part of the common law. If there is a dispute over the question of whether a public right of way exists, that is a matter which can be resolved thoughout the courts.

I have not received any indication that the law on public rights of way is ineffective and I have no proposals at present to amend the law in this area
