Written Answers. - Offences Against the State Act, 1939.

Question:

57 Tomás Mac Giolla asked the Minister for Justice if he intends to amend the Offences Against the State Act, 1939, to take into account the findings of the Supreme Court, in its judgment given on 11 July 1991, that section 34 was unconstitutional; if, in view of the fact that it is now more than 50 years since the Act was introduced, he intends to undertake any overall review of the Act; and if he will make a statement on the matter.

The outcome of the case concerned and the question of what action may be necessary as a result is currently the subject of consideration within my Department and others which may be affected also. The Deputy will of course appreciate that I could not undertake to indicate, by way of reply to a parliamentary question, what specific legislative proposals I might have in a particular area. In accordance with normal practice, and such proposals I may have are announced in the ordinary way when they have been considered by the Government.
