Question:

107 Mr. Gregory asked the Minister for Social Welfare if he will review the decision to stop unemployment assistance payments to a person (details supplied) in Dublin 1, because his wife is a part-time street trader, in view of the hardship being caused to the family concerned.

Following a review of his unemployment assistance claim, the person's claim was disallowed by a deciding officer from 10 July 1991, on the grounds that he had failed to show that his means did not exceed the statutory limit for receipt of assistance.

He appealed this decision to the independent social welfare appeals office, and following further investigation by a social welfare officer, an oral hearing of his appeal was held on 30 January 1992. On the basis of the evidence available the appeals officer upheld the decision of the deciding officer in the matter.

Following receipt of further representations, the appeals officer proposes to have a further oral hearing. This hearing will be arranged for an early date.

Toddy O'Sullivan

Question:

108 Mr. T. O'Sullivan asked the Minister for Social Welfare when a decision will be made on an unemployment assistance appeal by a person (details supplied) in County Cork.

The person concerned applied for unemployment assistance from 14 January 1992. His application was refused on the basis that his means, derived from self-employment and spouse's income, exceeded the statutory limit.

The person concerned appealed this decision to the independent social welfare appeals office on 25 February 1992. The appeals officer requested a further report from a social welfare officer which is now to hand. The appeal is being listed for an oral hearing at an early date.
