Written Answers. - Malpractices under Company and Consumer Legislation.

Question:

58 Mr. Quinn asked the Minister for Industry and Commerce if action has been taken by his Department or by the Director of Consumer Affairs against a person (details supplied) in Dublin 7 for malpractices under company and consumer legislation; and if he will make a statement on the matter.

On 19 September 1991 the person referred to, trading under one of the company names supplied, was prosecuted by the Director of Consumer Affairs for breach of section 11 of the Sale of Goods and Supply of Services Act, 1980. The defendant was convicted and fined £200. On the same date the defendant was also convicted for a contravention of the Industrial Research and Standards (Fire Safety Domestic Furniture) Order, 1988, on three counts. He was fined £50 on each count and ordered to pay £350 in expenses.

Recently the Director received a complaint about the same individual, trading under the other company name supplied by the Deputy. In this instance the complainant was advised to use the Small Claims Procedure. I have learnt, however, that the claimant has since received a refund from the company in question.
