Written Answers. - Access to Canal Bank.

Question:

92 Mr. Durkan asked the Minister for Finance when obstructions will be removed from the right of way on the banks of Royal Canal, Moyvalley, County Kildare, which now impedes access to other land locked property of a person (details supplied) in County Kildare having particular regard to the fact that this access has existed unimpeded for generations; if it is acknowledged that clear access must be maintained to the property in question including the removal of unplanned trees or other undergrowth; and if he will make a statement on the matter.

Under the Canals Act, 1986 the Commissioners of Public Works have responsibility for the care, management and maintenance of the Royal Canal as a public amenity.

The bank in question forms the south bank of the Royal Canal between Moyvalley Bridge and Ribbontail Footbridge. The bank is not subject to any right of way and contains many Ash and Sycamore trees with attendant dense bramble and scrub which, aside from being an attractive feature along the canal bank, indicates it has not been disturbed for some considerable time. The Commissioner's policy is to minimise interference with existing vegetation and wildlife and they have no plans to provide vehicular access along this bank. The north bank along this stretch has a walkable towpath which is sufficient for general access and for canal maintenance purposes.
