Robert Molloy

Question:

60 Mr. Molloy asked the Minister for Justice when the Judicial Commission referred to in the Programme for a Partnership Government 1993-1997 will be established; and if she will make a statement on the matter.

I am not in a position to say when exactly this commission will be established but I can confirm that the commitments contained in the programme will be honoured and that the consultation process which will be required in advance of the establishment of the commission will commence without delay.

Charles Flanagan

Question:

61 Mr. Flanagan asked the Minister for Justice the priority areas for expansion of the small claims court; and if she will make a statement on the matter.

The small claims procedure has been operating on a pilot basis in four locations since December, 1991. I am currently reviewing all aspects of the operation of the procedure including the monetary limit, the types of cases which fall under the scheme and the areas served by the procedure. Until this review is completed I will not be in a position to give any indication of how or to what areas the procedure will be expanded.
