Question:

86 Mr. Callely asked the Minister for Justice when proceedings under the Offences Against the Person Act, 1861, and the Labouchere Amendment of 1885 were last taken under any other Act; when there was prosecution for engaging in homosexual activity; when new legislation will be introduced; and if she will make a statement on the matter.

Details of proceedings for offences related to sections 61 and 62 of the Offences Against the Person Act, 1861 and section 11 of the Criminal Law (Amendment) Act, 1885 are set out in the Garda Síochána Annual Report on Crime under the category of unnatural offences. These reports are available in the Library.

Legislation on the subject of homosexuality will be introduced shortly in line with the commitment in the Programme for a Partnership Government.
