Question:

45 Mr. Deenihan asked the Minister for Justice the reason a business permit has not been granted to a person (details supplied) in County Kerry despite the fact that he applied for this four years ago.

It has never been the practice to provide details concerning individual cases of this kind in reply to Dáil questions and there are very good reasons for maintaining this practice.

However, as the Deputy's question suggests that he may be under the impression that what is involved here is simply a four year delay between the application for a business permit and a decision I can confirm that this is certainly not the case.

The applicant himself is sufficiently aware of the background circumstances to know why a permit could not be granted; he has been informed over a year ago that the application was refused and informed more recently than an appeal has also been refused.

I will review the application referred to by the Deputy on receipt of further submissions from the applicant and his legal representatives.
