Question:

145 Mr. J. Bruton asked the Minister for Agriculture, Food and Forestry if his attention has been drawn to any EC action within his area of departmental responsibility against this State in respect of the failure of the State to transpose into Irish law an EC Directive; if so, if he will give details of each such directive; the purpose of the directive; and the reason for his Department's failure to transpose it into domestic Irish law to date.

Details of EC Directives in respect of which "reasoned opinions" have been received from the EC Commission or which are the subject of European Court of Justice proceedings are set out in the following tabular statement. Over 100 directives have fallen to be transposed by my Department over the past four to five years, the vast majority of which have been transposed. However, as the Deputy will appreciate, the drafting of such legislation is a complex and time consuming operation which requires a high degree of consultation between my Department, the Office of the Parliamentary Draftsman and the Office of the Attorney General. Work is progressing on the outstanding directives and every effort will be made to finalise their transposition as soon as possible.
