68 Mr. Allen asked the Minister for the Environment his views on whether it is reasonable that a person (details supplied) in County Cork who had a driving test on Thursday, 6 May 1993 at 2.30 p.m. and who unfortunately forgot his provisional driving licence was failed as a result, and must reapply and pay a further £30 for a new appointment, having regard to the fact that many applicants have been inconvenienced in the past with cancellation of driving test appointments; and if he will now instruct his Department to grant this person a further driving test without his having to pay a further application fee.

The Road Traffic (Licensing of Drivers) Regulations, 1989 preclude the testing of a person who does not hold a provisional licence. The requirement to bring the current provisional licence when being tested is clearly indicated on the notification of a test appointment. This person did not produce a provisional licence when he presented himself for testing consequently the test was not conducted. If he wishes to reapply, there is no option but to require him to pay a further fee.
