Question:

112 Mr. Finucane asked the Minister for Agriculture, Food and Forestry if, in the situation where a farmer who sells an acre for non-agricultural purposes, the present milk quota regulations impose a pro rata reduction on his milk quota; and if he will make a statement on the matter.

Under EC law, quotas are attached to land and are automatically transferred when land to which quota is attached is transferred. There is, however, provision in EC law for some flexibility in this area in certain prescribed circumstances, including the transfer of land for non-agricultural purposes. National implementing legislation is presently being prepared to give effect to this provision.
