Question:

113 Mr. Costello asked the Minister for Justice the circumstances under which a person (details supplied) in Dublin 3 was arrested, interrogated, his home searched, and released without charge; and if she will make a statement on the matter.

I am informed by the Garda authorities that the arrest in question was carried out under section 30 of the Offences Against the State Act, 1939. The search of the person's residence was made on foot of a warrant issued under section 29 of the Offences Against the State Act, 1939 (as substituted by section 5 of the Criminal Law Act, 1976). It is not the practice to disclose the information available to the Garda which causes such an arrest to be made or such a warrant to issue.
