Written Answers. - Southern Cross Motorway Scheme.

Question:

41 Mr. Shatter asked the Minister for the Environment when construction will commence on the Southern Cross Route and the realignment or construction of roads necessitated by the construction of the Southern Cross Route; the reason for the delay in the commencement of such construction; when the Southern Cross Motorway will be completed and opened to traffic; and whether a toll will be charged for use of the motorway.

167 Mr. Shatter asked the Minister for the Environment if a decision has been made on the reconstruction to be undertaken on the Ballinteer Road in the context of the construction of the Southern Cross Motorway following the Southern Cross Motorway enquiry in October 1991; and the reason for the delay in making a motorways order relating to the Ballinteer Road.

Question:

168 Mr. Shatter asked the Minister for the Environment the position regarding the court proceedings initiated by the Board of Management of Whitechurch national school arising out of ministerial decisions in relation to the Southern Cross Motorway scheme; and if he will make a statement on the matter.

I propose to take Questions Nos. 41, 167 and 168 together.

In August 1992, I approved, with modifications, the Dublin County Council (Southern Cross Route) Motorway Scheme, 1991, and six related Compulsory Purchase Orders made by Dublin County Council in respect of lands required for road improvement works associated with the proposed Southern Cross Route. In July last, I annulled another related compulsory purchase order — the Dublin County Council Compulsory Purchase (Ballinteer Road) Order, 1991. I understand that the Council is preparing a new order in respect of lands for an alternative scheme to realign and widen this road.

The overall Southern Cross project would take about four years to construct. Its commencement has been delayed because of proceedings initiated in the High Court against the Minister for the Environment and Dublin County Council. A Responding Affidavit has been lodged on my behalf with the Court following the Grounding Affidavit served by the plaintiffs, who include the Board of Management of Whitechurch national school. Arrangements are being made for the provision of documents relating to the project, as required by an Order for discovery which has been granted to the plaintiffs.
As the matter is nowsub-judice, and as I cannot forecast when the legal proceedings may be determined, it would not be appropriate for me to comment further on any aspect of the proposed scheme, including the possibility of tolling.
