Written Answers. - Unlicensed Radio Stations.

Question:

58 Mr. Noonan (Limerick East) asked the Minister for Transport, Energy and Communications his Department's policy regarding unlicensed radio stations; the procedures that are in place to ensure their closure; and if he will make a statement on the matter.

Under the Wireless Telegraphy Acts 1926 to 1988 it is an offence to possess or use apparatus for wireless telegraphy except under and in accordance with a licence issued by my Department. Unlicensed radio stations operate in contravention of these Acts. We have put in place a duly licensed local radio system in this country and unlicensed radio stations will not be permitted.

My Department investigates breaches of these Acts and prosecutes offenders. This requires a close monitoring of the frequencies in use and surveillance of the physical location of the transmitter. Where appropriate a warrant may be sought from the courts to search the premises and seize the equipment.

I also have the power, under the Broadcasting and Wireless Telegraphy Act, 1988, to prohibit the provision of telephone or electricity services to a structure or premises being used for illegal broadcasting. Moreover, since it is illegal to advertise on an illegal broadcast, my Department regularly notifies persons and businesses so advertising that such advertising is an offence liable to prosecution.
