Question:

69 Mr. Shatter asked the Minister for Justice whether her attention has been drawn to the fact that the current Circuit Court rules applicable to proceedings under the Judicial Separation and Family Law Reform Act, 1989, are defective and that new draft rules were submitted to Government by the Family Lawyers Association over six months ago; whether she intends to make the necessary order to give effect to the draft rules; and if so, when she will do so.

The Deputy will appreciate that rules of the kind in question are a matter in the first instance for the Circuit Court Rules Committee and my statutory functions is confined to concurrence in the making of such rules. I understand from the Circuit Court Rules Committee that the Family Lawyers Association made submissions to the committee in relation to the making of more detailed rules in relation to proceedings under the Judicial Separation and Family Law Reform Act, 1989, and I expect revised rules to be submitted to me by the committee for my concurrence shortly.
