Written Answers. - Environmental Damage Liability.

Question:

157 Mrs. Doyle asked the Minister for the Environment the way in which the policy of civil liability for environmental damage, as outlined in the Green Paper on remedying environmental damage, will be implemented by the EU; if polluter liability will have transboundary application; and if he will make a statement on the matter.

Wexford): The Green Paper on remedying environmental damage has been published by the European Commission as a consultative document. While there was a brief general discussion of the Green Paper at the Environment Council of 2-3 December 1993 no firm proposals for implementation are yet apparent.

The Green Paper refers to certain principles of international law relating to transboundary liability, and also details a range of international instruments relevant to civil liability and compensation, in particular, the Council of Europe Convention on civil liability for damage resulting from activities dangerous to the environment. However, the Green Paper does not purport to reach definite conclusions on the transboundary aspect.
