Question:

98 Mr. G. Mitchell asked the Minister for Justice if she will examine the case of a person (details supplied) in Dublin 24 who was stopped by a Garda at Wellington Place, near the Spawell on the Tallaght Road, Templeogue, Dublin in November 1987 and was told to produce his insurance which he did at Tallaght Garda Station the same month; this person subsequently moved to Germany in October 1988 and he was only then informed that his licence was endorsed for three years, he was fined £100 for not producing insurance and that this was decided at a court case in January 1989; if, in view of the fact that he did not receive any notice of the court case and did produce his insurance, will she review the case as the sentence handed down was an endorsement of his licence and this is now preventing him from obtaining a job as a taxi driver.

I have been informed by the Garda authorities that their inquiries into this case are not yet completed and, accordingly, they are not in a position to furnish me with a final report in the matter.

However, I am informed that this report will be completed very shortly and I will communicate with the Deputy when it is made available to me.
