Question:

64 Mr. G. Mitchell asked the Minister for Justice if a house which has been left to a person (details supplied) in Dublin 12 by his late mother in a valid will can be transferred to this person without cost in view of the fact that this persons only income is unemployment assistance of £59.20; and if he will waive probate costs in this case.

The scale of fees payable for the administration of a grant of probate in the Probate Office of the High Court and in the District Probate Registries is set out in the Supreme Court and High Court (Fees) Order, 1989. The fee payable in the Land Registry for a registration of transmission on death is £40, which is set out in the Land Registry (Fees) Order, 1991.

It is open to a person wishing to take out a grant of probate to make a personal application to the Probate Office, without having to retain the services of a solicitor. The fees charged for a personal application are assessed on the value of the relevant estate and are considered reasonable.

There is no provision in the relevant Order for the waiver of the probate fee or the Land Registry fee.
