Written Answers. - Parental Leave for Fathers.

Question:

111 Mr. Currie asked the Minister for Equality and Law Reform the implications of recent European and Labour Court decisions in relation to leave for birth and adoptive fathers; and if he will make a statement on the matter. [1235/94]

A draft EU Directive on Parental Leave which would provide for leave for both birth and adoptive parents was considered at the meeting of the Council of Ministers of Labour and Social Affairs on 22 September 1994. Ireland supported the draft Directive but the measure failed to secure the unanimity of support required for adoption by the Council. The Commissioner for Social Affairs has signalled the likelihood that the Commission will now take an initiative in this area under the Maastricht Treaty Agreement on Social Policy.

I understand that the recent Labour Court decision in relation to adoptive paternity leave is the subject of appeal to the High Court. The outcome of that appeal will be considered when it becomes available.
