203 Dr. Upton asked the Minister for Transport, Energy and Communications in respect of claims for negligence and nuisance against his Department for each year since 1990, the total number of claims made; the total number of claims settled; the total amount of money paid in settlements; the total amount of money paid in legal costs arising from the settlements; the total number of claims outstanding at present; and the estimated cost of these claims. Two claims for negligence and nuisance have been made against my Department since 1990. The first of these claims, which was made in 1990, involved a total of £5,437 paid in settlement, including a total of £2,037 paid in legal costs. Another public body was also the subject of the claim, and liability for the payments has not yet been finally agreed. The second claim, made in 1991, has recently been settled. The agreed settlement of £38,361, with legal costs of £9,513.94 is in the process of being paid by my Department. No other claims are outstanding at present.
