Vol. 452 No. 7

Written Answers. - Prohibition of Forcible Entry and Occupation Act.

Noel Ahern

Question:

20 Mr. N. Ahern asked the Minister for Justice if she will extend the Forcible Entry and Occupation Act to residences in order to assist local authorities to free and gain possession of their properties occupied by squatters. [6477/95]

The provisions of the Prohibition of Forcible Entry and Occupation Act, 1971, define land to which it applies as including "tenements of any tenure". Accordingly, my advice is that residences would be subject to the provisions of the Act although I should mention that the provisions of the Act apply to quite specific circumstances which may not arise in practice in the types of cases referred to in the question.
