Question:

39 Mr. Bell asked the Minister for Finance the final outcome of the withdrawal of the contractor appointed to the building of the Drogheda Garda barracks; the details of the arrangements made with the liquidator and the appointment of a new builder; the cost of this activity; if the original builder was the lowest tender in relation to the building; if he will confirm that her Department had the necessary information and guarantees regarding the financial position of the company; and if he will make a statement on the matter. Prior to placing a contract for this project with the lowest tenderer the Commissioners of Public Works satisfied themselves as to the financial viability of the company and its building competency. The necessary tax clearance certificates were furnished. The company had previously carried out a number of large projects on behalf of the commissioners and had always performed satisfactorily.

Following poor progress on site and having satisfied themselves that the company was in default of the contract the commissioners determined the employment of the contractor on this contract on 20 January 1995.
An insurance bond, for the purpose of protecting the commissioners' interest was in place and at no additional cost to the State a contract for completion of the works was placed on 10 April 1995 with a contractor nominated by the bonding company. Work is in progress at present.
