Written Answers. - Tour Operator's Liability.

Question:

17 Dr. McDaid asked the Minister for Transport, Energy and Communications the current situation regarding the Sportex victims of the World Cup in 1994. [11069/95]

Sportex is not licensed as either a tour operator or a travel agent in Ireland. I have, therefore, no function in regard to this company.

I am well aware of the disappointment and trauma suffered by fans who travelled to the World Cup in the US with this company. My Department has been in contact with the Department of Trade and Industry in the UK who have informed us that an investigation, by the Trading Standards Department, into the conduct of the affairs of Sportex has been ongoing for some time.

I will be keeping in touch with the situation and will be informed of the outcome of the current investigation when it becomes available. I am unable at this stage to say when that might be.

I should add, however, that as I understand it, the problems arising out of the World Cup package are primarily a contractual matter between the parties concerned and I believe that the question of legal action against Sportex is being considered by a number of the persons concerned.
