278 Dr. O'Hanlon asked the Minister for Justice if her attention has been drawn to the concern of shopkeepers, domestic leaseholders and the people of a town (details supplied) in County Monaghan at the increase in the cost of leaseholds and the problems associated with such leaseholds; the action, if any, she proposes to take to deal with such matters; and if she will make a statement on the matter. Carrickmacross Urban District Council wrote to me recently expressing concern at increases in rents which had arisen in particular cases. The rights of landlords and tenants fall to be determined in the first instance by reference to the provisions of the tenancy agreements which have been entered into. Certain statutory protections for tenants are contained in the Landlord and Tenant Acts and a person's own legal advisor would be the appropriate person to advise in relation to the facts of a particular case.

The Deputy will appreciate that I have no powers or function in relation to the operation of the Landlord and Tenant Code in particular cases. However, if the Deputy has any specific proposals for change in landlord and tenant legislation I will, of course, arrange to have examined any submission which he might wish to make in this regard.
