Vol. 457 No. 7

Written Answers. - High Court Costs.

John O'Donoghue

Question:

255 Mr. O'Donoghue asked the Minister for Justice the reason the State sought costs against the plaintiffs in a High Court case (details supplied); and if she will make a statement on the matter. [16187/95]

I understand that the practice of the courts in the matter of costs is well settled: except in the most exceptional circumstances costs follow the event. In this case all of the plaintiffs' claims against the State failed entirely and, in accordance with normal practice in such circumstances, the State applied for and was awarded costs.
