20 Mr. Molloy asked the Minister for Transport, Energy and Communications whether a CIE official briefed his Department on the Horgan's Quay site sale from CIE files on 3 November 1994; whether CIE submitted a memorandum on the Horgan's Quay site sale to his Department on 11 November 1994; and whether he discussed the Horgan's Quay site sale with CIE Group Chief Executive in May 1995. 31 Mr. D. Wallace asked the Minister for Transport, Energy and Communications the steps, if any, he took to withdraw from the Horgan's Quay contract. [17436/95]

I propose to take Questions Nos. 20 and 31 together.

On 3 November 1994 a CIE official briefed my Department by telephone as part of its preparations for an Adjournment Debate later that day on the proposed disposal of the Horgan's Quay site. Following the Debate, CIE submitted a Memorandum to my Department on 11 November, 1994. Shortly after his appointment in May 1995, I met the new CIE Group Chief Executive to discuss a range of issues. During our meeting the Horgan's Quay issue was briefly discussed.

The negotiation of the contract for the disposal of the Horgan's Quay site was a matter for CIE and O'Callaghan Properties. Neither I nor my Department had any involvement in these negotiations. Consequently the question of my seeking legal advice in relation to this disposal did not arise.
