Vol. 464 No. 6

Written Answers. - Suspended Sentences.

Liz O'Donnell

Question:

159 Ms O'Donnell asked the Minister for Justice the effect on a suspended sentence when the accused has indicated that he will be leaving the jurisdiction; the procedures in place to guard against re-offending or for breach of the bond when the accused leaves the jurisdiction; and if she will make a statement on the matter. [8660/96]

It is a matter for the sentencing court to determine the conditions of a bond, including the consequences of a breach thereof, entered into by an accused as a condition for the suspension of a sentence.

The courts are, subject only to the Constitution and the law, independent in the exercise of their judicial functions.
