Written Answers. - Land Commission Agreement.

51 Mr. Deasy asked the Minister for Agriculture, Food and Forestry whether his Department will adhere to an agreement made by the Land Commission in 1982 with a person (details supplied) in County Waterford which granted permission for the laying of a water pipe on land then owned by the Land Commission. [8167/96]

A scheme for the disposal of the lands in question was prepared in 1982. This scheme has provided for a way-leave for the water pipe in question. However, it was not operated as agreement regarding exchanges could not be reached with the allottees. A supplemental scheme was prepared in 1988. This scheme, unfortunately, did not provide for a way-leave for the water pipe. I understand that the person in question is now experiencing some difficulty in obtaining access to maintain and repair the pipe. In the circumstances, officials of my Department are in contact with the two parties concerned. I am advised that negotiations are at an advanced stage and it is hoped that a mutually satisfactory agreement will be achieved. I will keep the Deputy advised of progress in the matter.
