193 Mr. Ring asked the Minister for Social Welfare the reason a person (details supplied) in County Mayo who applied for a deserted wife's benefit is being discriminated against by his Department in view of the fact that her husband, who is no longer living with her, made false allegations. [10899/96]

The person concerned applied for deserted wife's benefit in January 1996. A decision on her entitlement has not yet been made.

The delay in this case results from the need to obtain additional evidence relating to the circumstances of the break-up of her marriage. There are inconsistencies in the information provided by the two spouses. The evidence available to date has been insufficient to establish that the husband of the person concerned left of his own violation.

The nature of the additional evidence which the person concerned is being asked to furnish has been explained to her by letter dated 15 May 1996.
When a response to this request has been received, a decision will be made on her claim and the person concerned will be notified of the result without delay.
