Question:

107 Mr. N. Ahern asked the Minister for Finance if he will give details of the daily ministerial and Civil Service pensions being received by Mr. Conor Cruise O Brien; whether his recent election to the Northern Ireland forum will affect his position; the conditions, if any, under which pensions can be reduced or withdrawn; and if he will make a statement on the matter. [12866/96]

As a former Member of the Oireachtas and Minister, the person in question received pensions in accordance with the terms of: the Houses of the Oireachtas (Members') pension scheme; and the Ministerial and Parliamentary Offices Act, 1938, as amended.

Under the terms of the Members' pension scheme, if the person became entitled to sit in either House of the Oireachtas the pension would cease to be paid with effect from the date on which the person's salary commenced. Under clause 8 of the Members' scheme, the payment of the pension would also cease in the case of bankruptcy or related circumstances.

As regards the ministerial pension, it would cease to be paid if the person in question was appointed to a qualifying office (e.g. appointed a Minister) or as Attorney General.

The person in question is not in receipt of a Civil Service pension and has no entitlement to one.
