Question:

115 Mr. M. McDowell asked the Minister for Enterprise and Employment the number of examinerships that have been established under the Companies Act, 1990; the plans, if any, he has to amend the legislation; and if he will make a statement on the matter. [13831/96]

The number of examiners appointed by court order under the Companies (Amendment) Act, 1990 is as follows:—

While the Deputy will be aware that examinership is a court procedure, a requirement exists to notify the Companies Registration Office in each case. Accordingly, the above figures, which are the latest available from the Companies Registration Office, are based on examinership appointments notified to that office and relate to the date of registration of the relevant documents and not to the actual date of appointment.
With regard to plans for amending the examinership legislation, the Minister with responsibility for commerce, science and technology is at present considering proposals prepared on foot of the recommendations of the Company Law Review Group in this area and he intends to bring forward legislation to implement those proposals which he considers appropriate.
