Vol. 473 No. 4

Written Answers. - Prison Accommodation.

Tony Gregory

Question:

435 Mr. Gregory asked the Minister for Justice the places of detention designated for the holding of prisoners for up to seven days in drugs-related investigations. [1413/97]

Section 2 of the Criminal Justice (Drug Trafficking) Act, 1996, permits persons suspected of drug trafficking offences to be detained in Garda stations for up to seven days. It also allows for the making of regulations designating places of detention where a person who is arrested under the Act and who is suspected of concealing drugs in his or her person may be detained. I am at present consulting with the Garda authorities about the question of making regulations under this provision. It is, of course, the case that, in the absence of designated places of detention, persons arrested under the Act suspected of having drugs concealed in their persons can be detained in Garda stations.
