Question:

543 Mr. Creed asked the Minister for Agriculture, Food and Forestry the current position regarding the subdivision of commonages, where such subdivision is opposed by a minority of farmers. [1396/97]

In cases where some, but not all, shareholders are in favour of division of their commonage the Land Commission has the power to effect a compulsory division, subject to the rights of objection and appeal available to the objectors. However, the use of this power of compulsory division has been suspended pending the resolution of an appeal to the High Court against the compulsory division of a commonage in the County Mayo townlands of Glenamadoo and Bunnahowna. This is the first time that the legislation used in the compulsory division of commonage has been referred to the High Court and the Land Commission will re-assess its policy and procedures with regard to compulsory cases in the light of the judgment of the court.

544 Mr. Creed asked the Minister for Agriculture, Food and Forestry when a person (details supplied) in County Cork will be paid his reactor grants. [1402/97]

TB reactor grants due to the person named will be processed for payment on receipt of a tax clearance certificate from the herdowner.
