Vol. 473 No. 5

Written Answers. - Registration of Title.

Liam Aylward

Question:

142 Mr. Aylward asked the Minister for Justice if she will expedite an application for registration by persons (details supplied) in County Kilkenny which was submitted to the Land Registry in August 1996. [1816/97]

I am informed by the Registrar of Titles that this dealing refers to an application under section 49 (i.e. acquisition of title by adverse possession) of the Registration of Title Act, 1964 which was lodged on 1 October 1996.

I understand that due to their complicated nature, applications under section 49 take some time to process and it is not possible to estimate a completion time. However, I can confirm that the matter is being expedited by the Land Registry.

Question:

143 Mr. Aylward asked the Minister for Justice if she will expedite an application for transfer by persons (details supplied) in County Tipperary where a query, which issued to a solicitor in December 1996, was replied to by registered post on 3 January 1997. [1817/97]

I am informed by the Registrar of Titles that this is an application for conversion of title and transfer of part which was lodged on 29 August 1996. I understand that the solicitor's replies of 3 January 1997 did not deal with the queries raised by the Land Registry and that further queries were issued to the lodging solicitors on 21 January 1997 to which replies are awaited. The matter cannot proceed until the queries raised are satisfactorily discharged and it is, therefore, not possible to estimate a completion time at this stage.

John Ellis

Question:

144 Mr. Ellis asked the Minister for Justice if she will request the Land Registry to expedite registration of property for a person (details supplied) in County Leitrim which has been outstanding for some time. [1818/97]

I am informed by the Registrar of Titles that it is expected that this dealing will be completed on 1 February 1997.
