Written Answers. - County Meath Arrest.

247 Mr. Costello asked the Minister for Justice the circumstances surrounding the arrest of a person (details supplied) in County Meath under mistaken identity on 18 January 1997, his detention in Harcourt Street Garda station, the refusal to allow him telephone his parents, the subsequent incorrect statement on the 19 January 1997 to his parents that he had been charged with larceny when he had not been charged with any offence; and if she will make a statement on the matter. I am informed by the Garda authorities that on the date in question the gardaí were called to deal with the alleged larceny of a wallet on a nitelink bus. Two passengers claimed that the person referred to by the Deputy had stolen the wallet from them earlier that evening.

When it transpired that the allegations made were false, the person was released from Garda custody and provided with transport to his grand-mother's home. I am informed by the Garda authorities that, while in custody, the person was treated in accordance with the regulations at all times and was advised of his rights. The parents of the person concerned subsequently spoke to the gardaí who were dealing with the matter and were fully and correctly appraised of the situation.

Garda investigations into the allegations which led to the arrest are continuing.
