Question:

183 Mr. Lenihan asked the Minister for Justice the proposals, if any, there are for providing a right of appeal following a decision of the Director of Public Prosecutions in relation to the institution of prosecutions. [5618/97]

I assume that what the Deputy has in mind is that the Director of Public Prosecutions should have a right of appeal where, following a preliminary examination, the District Court refuses to order a person to be returned for trial on indictment. This is one of a number of aspects of the law relating to criminal appeals that are the subject of review by my Department. The question of making changes in that general area gives rise to complex issues and any legislative proposals which emerge from the review will be announced in the usual way.
