Vol. 475 No. 7

Written Answers. - Registration of Title.

Michael Ring

Question:

198 Mr. Ring asked the Minister for Justice when maps will issue to a person (details supplied) in County Mayo from the Land Registry Office in view of the fact that the family in question is in need of these maps to enable their local authority to build them a rural council house, they have three young children and have no running water in their current accommodation. [5847/97]

I am informed by the Registrar of Titles that there is no record of any application currently pending on this folio. I understand that a copy Folio and file plan map issued on 21 February 1994 to the registered owner under reference MA 407/94.

Michael Bell

Question:

199 Mr. Bell asked the Minister for Justice the reason for the five year delay in rectifying the error in relation to the registration of folios (details supplied); if her attention has been drawn to the fact that because of this error a person (details supplied) in County Louth cannot secure any mortgage on his property; whether this problem was caused by an error by Louth County Council in the initial registration of these folios; if she will have arrangements made for these folios to be corrected; if her attention has further been drawn to the fact that both parties received proper planning permission from Louth County Council; her views on whether a grave injustice has been caused to the person affected; and if she will make a statement on the matter. [5848/97]

I am informed by the Registrar of Titles that this dealing is an application for rectification of two folios. It was lodged in the Land Registry for the first time on 17 July 1996, on behalf of four applicants. Queries issued to the lodging solicitor for one of the applicants on 24 October 1996 and again on 4 December, 1996 and replies are awaited to the latter queries.

In order to clarify the position regarding the correction of the alleged error in this case, I am obtaining full details of the registrations on the folios mentioned by the Deputy and I will then write to him about the matters which he has raised in his question. I am satisfied, however, that as far as the Land Registry is concerned, the matter has been handled with due proficiency and attention.
