Question:

197 Mr. Aylward asked the Minister for Justice the reason warrants are being issued and executed by the Garda in cases where petitions (details supplied) have been lodged to her which have been acknowledged and in respect of which advice has been given to produce the acknowledgement to the Garda as proof of petition in view of the fact that no further process of the case has taken place or a final decision been given on the petition; and if she will make a statement on the matter. It is normal practice for the Garda Síochána to defer enforcement of a warrant in respect of a fine which is under petition. However, there is no statutory requirement on them to do so.
