Question:

105 Mr. N. Ahern asked the Minister for the Environment the procedures, if any, which a private resident can take to rid themselves of the nuisance of a barking dog at night. [10602/97]

Under section 25 of the Control of Dogs Act, 1986 a person may seek redress in the District Court where a nuisance has been created by excessive barking by a dog. It is open to the court to order that specific measures be taken to abate the problem.

In addition, powers have been provided in the Environmental Protection Agency Act, 1992 to address problems of noise pollution. Under section 108 of the Act, a person may seek an order in the District Court to have the noise abated. An information leaflet has been published by my Department on the procedures involved and is widely available.
