Vol. 478 No. 4

Frances Fitzgerald

Question:

267 Ms F. Fitzgerald asked the Minister for the Marine the EU directives coming wholly or partly under the auspices of his Department that are not currently fully implemented; the reference number and subject matter of each directive; the deadline for implementation set out in the directive; whether it is proposed to implement the directive by means of a Bill or by statutory instrument; and when it is proposed to implement the directive. [11359/97]

Details of the EU directives coming wholly or partly under the auspices of the Department of the Marine which have not yet been transposed are set out in the following table.

TABLE

Reference Number of Directive.

Subject matter-deadline for implementation.

89/662/EEC

94/25/EEC

Approximation of the laws, regulations and administrative provisions of the member states relating to recreational craft. 16 June 1996.

94/57/EEC

Common rules and standards for ship inspection and survey organisations and for the relevant activities of maritime administrations. 31 December 1995.

94/58/EEC

Minimal level of training for seafarers. 31 December 1995.

95/21/EEC

The enforcement, in respect of shipping using Community ports and sailing in the waters under the jurisdiction of the member states, of international standards for ship safety, pollution prevention and shipboard living and working conditions (port State control). 30 June 1996.

95/22/EEC

Animal health conditions governing the placing on the market of aquaculture animals and products. 1 June 1997.

I intend that all of these directives will be transposed into Irish law as soon as possible — preparatory work for transporting many of them is at an advanced stage. While directives for which the Department of the Marine is responsible are normally transposed by way of Regulations under the European Communities Acts, the legal means of transposition for these directives will be settled in each case in consultation with the Attorney General's office.
