Seán Haughey

Question:

245 Mr. Haughey asked the Minister for Justice, Equality and Law Reform when the Land Registry will register related properties (details supplied) in County Meath; and if he will make a statement on the matter. [17200/97]

I am informed by the Registrar of Titles that Folio No. 2954 refers to an application under section 49, i.e. acquisition of title by virtue of long possession, of the Registration of Titles Act 1964 which was lodged on 30 December 1996. I understand that due to their complicated nature, applications under section 49 take some time to process and it is not possible to estimate a completion date at this stage.

I am further informed that queries issued on this dealing to the lodging solicitor on 14 October 1997 and replies are awaited. The queries raised must be satisfactorily discharged before the matter can proceed.

I am informed by the Registrar of Titles that Folio No. 9704, which refers to a transmission on death, is expected to be completed within the next week.

Michael Finucane

Question:

246 Mr. Finucane asked the Minister for Justice, Equality and Law Reform the way in which a person (details supplied) in County Limerick who has possessory title can transfer a 1/2 acre site to his son to receive absolute title in view of the fact that he is unable to get a mortgage because of the current situation; and if he will make a statement on the matter. [17249/97]

I am informed by the Registrar of Titles that there is currently no dealing pending on this Folio. In order to convert the possessory title of this folio, a suitable application should be lodged in the Land Registry in accordance with Rules 33-37 of the Land Registry Rules 1972.
