268 Mr. G. Mitchell asked the Minister for the Environment and Local Government if he will examine the need to amend planning law or planning regulations to ensure that local authorities are not allowed to grant planning permission for industrial buildings in close proximity to private houses without ensuring that transparent glass is not allowed and by ensuring that the privacy of home owners is not invaded in view of a case (details supplied) in Dublin 12. [18234/97]

The issue raised in the question is one of practice within existing planning legislation rather than one of amending that legislation. It is a matter for each planning authority to decide whether or not to grant planning permission and the type of conditions, if any, which should apply, depending on the particular circumstances of a case. Any person aggrieved by a decision of the planning authority has the right of appeal to An Bord Pleanála.
