207 Mr. Cosgrave asked the Minister for Justice, Equality and Law Reform the reason for the delay by the Garda Síochána in sending a report to the Director of Public Prosecutions on an alleged rape in a hospital (details supplied) in Dublin 3 on 5 June 1997; the reason no one has to date been charged with the incident in spite of the fact that the attack was witnessed by a hospital staff member and a suspect was detained at the scene by gardaí and brought in for questioning; if he will give details of the current position in this regard. I have been informed by the Garda authorities that, following a comprehensive investigation, a file in the matter has been forwarded to the Director of Public Prosecutions whose directions are now awaited. In the circumstances, it is not appropriate for me to make any further comment.
