Question:

312 Mr. Quinn asked the Minister for Public Enterprise the Acts and provisions of Acts which are not in force due to the fact that a commencement order has not been made; whether an order will be made, if so, when this will occur; and if she will make a statement on the matter. [1080/98]

A commencement order has not been made in respect of Part III of the Air Navigation and Transport Act, 1988, to give effect to four 1975 Protocols to the Warsaw Convention. All four protocols have been ratified by Ireland. The Warsaw Convention established minimum levels of liability for, inter alia, the carriage of passengers and cargo; and the four Protocols updated the compensation limits of the Warsaw Convention. However, the first two protocols only became part of international law in 1997. The question of making a commencement order to give effect to these two protocols is being examined in the light of recent developments under EU legislation dealing with issues similar to those covered by the Warsaw Convention.
