360 Mr. Spring asked the Minister for Defence the reasons for a commission being relinquished under section 48(6) of the Defence Act, 1954; the reasons for commissions being otherwise withdrawn; and the numbers of officers of the FCA and An Slua Muirí who are anticipated to retire on age grounds in each of the years 1999 and 2000. Under section 48 (2) of the Defence Act, the President may for any prescribed reason direct that an officer should relinquish his commission.
Defence Force Regulations made pursuant to subsection 48(2) of the Act provide for an officer's commission to be relinquished for any of the following reasons: (1) that he is below the required medical standards; (b) that he is of unsound mind; (c) that he has failed to carry out his military obligations as required by the Act and-or by Regulations made under the Act; (d) that the relinquishment of his commission is in the interests of the service.
Section 48 of the Defence Act also provides as follows:—
48(3) The President may direct that an officer whose appointment as an officer is temporary shall relinquish his commission and in any such case such officer shall relinquish his commission.
48(4) An officer of a prescribed description (which may be prescribed by reference to rank or appointment or both or such other matters as the Minister thinks proper) shall relinquish his commission on reaching the age prescribed as the age for the relinquishment of commissions by officers of that description.
48(5) An officer whose appointment as an officer is for a specified period shall relinquish his commission on an expiration of that period.
48(6) An officer who becomes a member either House of the Oireachtas or who assumes the office of representative in the Assembly of the European communities shall thereupon relinquish his commission.
The number of officers of the FCA and An Slua Muirí who are anticipated to retire on age grounds in 1999 and 2000 are as follows:—
