Vol. 486 No. 1

Written Answers. - Claims against the State.

Deirdre Clune

Question:

60 Ms Clune asked the Minister for Finance if his Department will consider the establishment of a specialist agency to manage all claims against the State, or State agencies, including local authorities, for damages arising from alleged negligence; and if he will make a statement on the matter. [1921/98]

The Government has already decided that a State claims agency should be established whose function would be to manage claims for compensation in respect of accidental personal injury and property damage made against the State, the Attorney General, Ministers, Government Departments and Offices, community and comprehensive schools, and residential centres for young offenders. The drafting of heads of Bill to establish the agency is at an advanced stage. It is not envisaged at this point that the agency would have similar functions in relation to any other State agency, including local authorities.
