Vol. 486 No. 1

Written Answers. - Registration of Title.

Michael Ring

Question:

786 Mr. Ring asked the Minister for Justice, Equality and Law Reform if he will instruct the Land Registry Office to rectify the problem with a land transfer for a person (details supplied) in County Galway. [1846/98]

I am informed by the Registrar of Titles that this application, which relates to the amendment of Folios 18031F and 25422, was lodged in the Land Registry on 17 November 1997. I understand this matter is being investigated at present and if it is found that an error was made by the Land Registry, it will be rectified immediately. It is not possible to say at this stage when the investigation will be completed but I am assured that the Land Registry will do everything possible to expedite the resolution of this application.

Question:

787 Mr. Ring asked the Minister for Justice, Equality and Law Reform if his Department will expedite the registration of lands for a person (details supplied) in County Mayo in view of the fact that requisitions have been answered; and if his Department will proceed with this registration as in the case of an associated similar dealing (details supplied). [1847/98]

I am informed by the Registrar of Titles that these dealings refer to applications under section 49 — that is acquisition of title by virtue of long possession — of the Registration of Title Act, 1964 which were lodged on 11 September 1996 and 20 January 1997. I understand that due to their complicated nature applications under section 49, which require detailed examination of the applicant's claim for registration as owner, take some time to process. I am informed that further queries have arisen in these cases which have been put to the applicant's solicitor. The queries must be satisfactorily discharged before the matter can proceed. Finally, I can confirm that the Land Registry will do everything possible to expedite the resolution of these applications.
