Question:

202 Mr. R. Bruton asked the Minister for the Environment and Local Government whether proposals under assessment will continue to be treated under existing law or if the proposed roads legislation published before Christmas 1997 will apply retrospectively; and if there is precedent for such restoration. [2566/98]

I assume that the question refers to the provisions of section 5 of the Roads (Amendment) Bill, 1997 which is currently before the House. That section proposes the establishment of revised arrangements for judicial review of decisions of the Minister for the Environment and Local Government, under the Roads Act, 1993 on motorway, busway or protected road schemes and on roads-related environmental impact statements. The section would apply to applications for judicial review made after its commencement.
