Question:

105 Mr. Haughey asked the Tánaiste and Minister for Enterprise, Trade and Employment if her Department will grant a work permit to a person (details supplied) in Dublin 3; and if she will make a statement on the matter. [2441/98]

Applications for work permits are considered under the Aliens Act, 1935, the Aliens Orders, 1946 and 1975 and the European Communities (Aliens) Regulations 1977-93. An application for a work permit on behalf of the individual concerned was, after correspondence with the company concerned, refused on 28 August 1997.

The decision to refuse this application was made on the basis that the proposed employee had, previously, been working here without having had a work permit issued on his behalf. The position is that a non-EEA national must have a valid work permit issued on his or her behalf before entering employment in this country. It is the policy of my Department not to consider applications for work permits on behalf of persons who are in breach of the relevant legislation.
